Title of Agenda Item:AGREEMENT - A RESOLUTION OF THE TOWN OF DAVIE, FLORIDA, RATIFYING AND APPROVING THE USE AGREEMENT BETWEEN THE DAVIE COMMUNITY REDEVELOPMENT AGENCY AND TUBACH MOTORS, INC FOR THE POST-CLOSING OCCUPANCY OF 4301 DAVIE ROAD; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
Executive Summary: 

The Davie CRA approved a purchase and sale agreement to purchase 4301 Davie Road, owned by Tubach Motors, Inc., on May 20, 2026.  As part of this agreement, the CRA agreed to execute a post-closing occupancy use agreement whereby Tubach Motors, Inc will have the right to utilize the property for up to 24 months following property closing and has to post a $250,000 holdback to cover any damages caused during its tenancy or environmental remediation due to discharges that occurred during their post-occupancy. Tubach Motors, Inc. will be responsible for paying all utilities and property tax up to the amount of Property Taxes it would have been required to pay had Tubach Motors, Inc. remained the owner of the Property for the entire tax year.  Finally, Tubach Motors, Inc. will maintain liability insurance as required by the Town’s Risk Manager.

 

This resolution will ratify and approve the use agreement with Tubach Motors, Inc. for occupancy of 4301 Davie Road upon the CRA’s property closing.  The 2-year term of occupancy shall commence upon closing.  The Town Administrator and Town Attorney are authorized to accept non-substantive changes to the Use Agreement prior to its execution at property closing.
