Title of Agenda Item:REZONING - AN ORDINANCE OF THE TOWN OF DAVIE, FLORIDA, APPROVING REZONING APPLICATION ZB25-040, BEVERLY TOWNHOMES, CHANGING THE ZONING DESIGNATION OF CERTAIN LANDS WITHIN THE TOWN OF DAVIE FROM AGRICULTURAL (AG) DISTRICT TO LOW MEDIUM DWELLING (RM-5) DISTRICT; AMENDING THE TOWN ZONING MAP TO COMPLY THEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE (990 and 1000 Flamingo Rd and 971 SW 121 Ave). . (Approved on first reading May 6, 2026. Councilmember Alfonso moved to approve the item. Vice Mayor Whitman seconded the motion. Executive Summary: 

The proposed ordinance would rezone the subject property from Agricultural (AG) District to Low Medium Dwelling (RM-5) District.

 
Key Points:
  • The proposed rezoning would be consistent with the existing land use designation of Residential 5 DU/Acre.
  • The Residential 5 DU/Acre land use category is primarily intended to accommodate residential uses at a density of up to 5 DU per gross acre. 
  • Sec. 12-24 of the Town Code identifies R-4, R-5 and RM-5 as being suitable zoning districts to implement the Residential 5 DU/Acre land use category.
  • The applicant has submitted concurrent Site Plan and Plat applications.
  • The petitioner has satisfied the public participation requirements (see attached).
  • Note that new public correspondence has been added to the backup since the first reading.
Previous Actions:At the May 7, 2026 Town Council meeting, Councilmember Alfonso moved to approve item #22, Rezoning Application ZB25-040. Vice Mayor Whitman seconded the motion. In a roll call vote, motion carried by a majority vote 5/0.
Concurrences:At the April 7, 2026 Planning & Zoning Board meeting, a motion was made by Ms. Lee, seconded by Mr. Dixon, to approve ZB25-040 Beverly Townhomes.
