The proposed Deed of Conservation Easement is intended to satisfy a requirement of the Open Space Overlay in connection with Site Plan SP23-059 (Shotgun Road Subdivision), currently under development by CC Homes at Estates by Turnberry LLC. Although the proposed easement is to be granted in favor of the Davie Area Land Trust, Inc., the Estates by Turnberry Homeowners Association will be responsible for the maintenance of the open space parcel.

• The Estates by Turnberry development was designed in accordance with Open Space Overlay regulations, which may require publicly accessible open space.
• The proposed Deed of Conservation Easement will ensure that the open space parcels approved as part of SP23-059 are protected from all forms of development, except as shown on the approved site plan.
• Although the proposed easement is to be granted in favor of the Davie Area Land Trust, Inc., the Estates by Turnberry Homeowners Association will be responsible for the maintenance of the open space parcel.
• The Town Administrator, or designee, shall have the authority to approve any non-substantive changes to the easement agreement.
